User Agreement / Terms and Conditions
Please read the following terms and conditions carefully.
By using the RepublicanSingles.com web site (the “Web site”) you agree to be bound by these Terms of Use (this "Agreement"), including all amendments made to date, whether or not you register as a member (“Member”). If you wish to become a Member and communicate with other Members and make use of the RepublicanSingles.com service (the "Service"), this Agreement constitutes your agreement with RepublicanSingles.com with respect to your use of the Service. You must agree to abide by all of the terms and conditions contained in this Agreement in order to become or remain an authorized user of the Service. If you do not agree to these terms and conditions, you may not use the Service and should not proceed to register.
Your right to use the Service is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion. We may alter, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database, or content. We may also impose limits on certain features and aspects of the Service or restrict your access to parts or all of the Service without notice or liability.
A. Conditions of Use
1. You represent, warrant and covenant that you are at least 18 years old.
2. Use of the Service, you consent to such disclosures and communications subject to the terms of our Privacy Statement
3. You will not impersonate others or authorize others to use your Service.
4. You will not use the Service to engage in any form of harassment or offensive behavior, including but not limited to the posting of communications, pictures or recordings which contain libelous, slanderous, abusive or defamatory statements, or racist, pornographic, obscene, or offensive language.
5. You will not transmit "junk mail", "spam", or "chain letters" or unsolicited group distribution of email through the Service.
6. You will not use the Service to infringe the privacy rights, property rights, or any other rights of any person in any way which violates, plagiarizes, or infringes upon the rights of any third party, including but not limited to any copyright or trade-mark law, privacy or other personal or proprietary rights, or is fraudulent or otherwise unlawful or violates any law.
7. You will not use the Service for commercial purposes or to distribute, promote or otherwise publish any material containing any solicitation for funds, advertising or solicitation for goods or services.
8. You will not use the Service to distribute or upload any virus, trojan horse or do anything else that might cause harm to the Service or to other members' systems in any way.
9. You will not access files, data or any account without authorization.
10. You will not disrupt the Service by any means.
11. You will not post or transmit in any manner any contact information including, but not limited to, email addresses, "instant messenger" nicknames, telephone numbers, postal addresses, URLs, or full names through your publicly posted information.
12. You will not forge any TCP/IP packet header or any part of the header information in any e-mail or posting.
13. You will not violate our security or the security of any of our affiliates.
14. You will not act in a manner that constitutes a crime or creates civil liability under any local, state, federal, national or other law or regulation.
B. Fees and Payments
In the event that you agree to participate in any paid Services or purchase any products, goods or services, you agree to timely pay the applicable fee as posted. We reserve the right to charge or change fees for access to elements of the Service by posting notice of the change on the Websites. Interest shall be applied to any amount not paid when due, and shall accrue at the rate of the lesser of one and one-half (1.5%) percent per month or the highest rate permitted by law
1. Full Members of the Service are required to purchase a "Subscription" in order to use the "paid features" of the Service.
2. Subscriptions are processed through BankCard USA and are subject to all Terms and Conditions therein.
3. Subscriptions are billed on a recurring 30 day cycle.
4. Subscriptions are not refundable after the full 30 day period is completed.
5. Subscriptions are not refundable if any of the “paid features” are used within that 30 day billing cycle.
6. You agree to pay or have paid all fees and charges incurred in connection with your membership with the Service (including any applicable taxes) at the rates in effect when the charges were incurred. All fees and charges are nonrefundable. We may change the fees and charges in effect for using the Service, or add new fees or charges, by posting new fees and changes on the site from time to time. You also are responsible for any fees or charges incurred to access the Service through an Internet access provider or other third party service, including but not limited to telephone charges. YOU, AND NOT WE, ARE RESPONSIBLE FOR PAYING ANY AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY, WHICH WERE NOT AUTHORIZED BY YOU.
C. Material
We reserve the right to monitor all advertisements, public postings and messages to ensure that they conform to the content guidelines which may be applicable from time to time.
You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Web site; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. RepublicanSingles is not responsible for any incorrect or inaccurate Content posted on the Web site or in connection with the Service, whether caused by users of the Web site, Members or by any of the equipment or programming associated with or utilized in the Service. RepublicanSingles is not responsible for the conduct, whether online or offline, of any user of the Web site or Member of the Service. RepublicanSingles assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. RepublicanSingles is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service. Under no circumstances will RepublicanSingles be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Web site or the Service, any Content posted on the Web site or transmitted to Members, or any interactions between users of the Web site, whether online or offline. The Web site and the Service are provided "AS-IS" and RepublicanSingles expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Your continued use of the Service now, or following the posting of notice of any changes in this Agreement, will constitute a binding acceptance by you of this Agreement, or any subsequent modifications.
The Service may from time to time contain links to other Internet sites and resources ("External Links"). You acknowledge that we are not responsible for, and have no liability as a result of, the availability of External Links or their contents. We suggest that you review the terms of use and privacy statement of such External Links prior to use of them.
D. Legal
We reserve the right to send electronic mail to you, for the purpose of informing you of changes or additions to the Service, or of any RepublicanSingles related products and services. We reserve the right to disclose information about your usage of the Service and demographics in forms that do not reveal your personal identity.
You are solely responsible for your interactions with other RepublicanSingles.com Members. RepublicanSingles.com reserves the right, but has no obligation, to monitor disputes between you and other Members
You agree to indemnify and hold RepublicanSingles, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above. You agree to indemnify us, our officers, directors, employees and agents, from any loss or damages, including without limitation reasonable legal fees, which we may suffer from your activities on or use of the Service, including without limitation any breach by you of this Agreement or any charges or complaints made by other parties against you. You shall cooperate as fully as reasonably required in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you; provided, however, that you shall remain liable for any such claim.
If there is any dispute about or involving the Web site and/or the Service, by using the Web site, you agree that the dispute will be governed by the laws of the State of Nevada without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of California , County of Clark .
Except in jurisdictions where such provisions are restricted, in no event will RepublicanSingles be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Web site or the Service, even if RepublicanSingles has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, RepublicanSingles's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to RepublicanSingles for the Service during the term of membership
You acknowledge that we are not responsible for suspension of the Service, regardless of the cause of the interruption or suspension. Any claim against us shall be limited to the amount you paid, if any, for use of the Service during the previous 12 months. We may discontinue or change the Service or its availability to you at any time and you may stop using the Service at any time.
This Agreement, accepted upon use of the Web site and further affirmed by becoming a Member of the Service, contains the entire agreement between you and RepublicanSingles regarding the use of the Web site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
